  1. At the auction closing time, the highest bid placed on any Item will be deemed the winning bid, assuming that such winning bid is greater than any optional reserve price that has been set on the Lot by the Seller.  The Buyer will receive an email notification of any winning bid and whether it meets the reserve price if appropriate.
  2. At the end of each auction, any bids placed on a lot within the last 10 minutes of the auction timer will extend the current auction for that lot by an additional 10 minutes until 12am. This is to ensure that "sniper software" cannot be used in any of our auctions.
  3. Asia Whisky Auction reserves the right to extend the auction timer by any length at any point during the auction, and under any event, specifically if the Website is not accessible at the initially proposed auction end time.
  4. Please note that Item(s) offered for sales may contain damage in the form of tears, rips, stains, scratches, dents, rust and more on bottles and boxes.  We attempt to highlight this damage within the lot description however if it is clearly visible within the images displayed the Buyer has been deemed to have seen this damage and has no claim or right to a refund.
  5. When a seller submits a request to us to list an item on our website, a contract between you (the seller) and us will be concluded in accordance with these terms governing your use of our website. When a buyer submits a bid to purchase an item through our website, a contract between you (the buyer) and us will be entered into in accordance with these terms to govern your use of our website. These contracts are separate from any contracts between buyers and sellers regarding the sales of goods.
  6. Our website lists the date and time the auction ends. When the auction is over, a contract is concluded between the seller and the highest bidder for the sale and purchase of the relevant goods. The contract contains these terms as long as they apply to the sale and purchase.



  1. Buyer’s fees & charges and payment responsibilities
  2. We would notify the successful bidders via email when an auction is concluded.

Payment surcharge of 3.5% if the payment is made via credit card; 1.2% if payment is made via PayMe.  HKD200 Bank Charge for international bank transfer.

  1. Payment to us can be made through bank transfer, FPS, credit card payment and PayMe.  Surcharge of 3.5% will be applied to payment using credit card. 1.2% if payment is made via PayMe.  HKD200 Bank Charge for international bank transfer.
  2. In case of payment through bank transfer, please make payment to our corporate account with HSBC.  If you choose this option, please quote your order number in the Payment Reference.  Our Corporate account details are as follows:

  1. In case of payment through PayMe, FPS, please quote your order number in the Payment Reference. 
  2. The successful bidder is obliged to pay us the costs as set out in 10.2.2 in full within five (5) days from the day after receipt of our confirmatory email. Once payment is received, title of the item(s) will pass to the Buyer. Any monies owed to Asia Whisky Auction after the five-day period of time will incur late payment interest at a rate of 3% per day. If payment is not received in full within this time, we reserve the right to (i) cancel the sale and re-auction the relevant lot(s) or return the lot(s) to the seller; and/or (ii) ban the buyer from using our website or services in the future.
  3. Asia Whisky Auction reserves the right to offer any lot to the second-highest bidder in the event of a cancelled sales, subject to agreement with the Seller of the said lot.
  4. Prior to an auction going live, Asia Whisky Auction reserves the right to update or change any commission rates and fees as it may in its sole discretion deem fit.

If the Buyer choose the delivery option, Asia Whisky Auction would arrange the delivery with third party service provider.  We aim to deliver the item(s) bought to you within 14 days of receiving payment, not the date that the auction ends; in the case of the Buyer choosing the delivery option. Please kindly check the Shipping & Insurance page before bidding to ensure that we can deliver to your location and the related shipping costs.  Please kindly note that you will be responsible for any local taxes, duties or any other requirements for your shipment. 
  2. The delivery costs listed on the Shipping & Insurance page on Our Website are for your reference.  Please note that the delivery costs shown are based on 1 bottle = 2 kg.  This is the weight of a standard bottle of whisky in a normal box.  Lots with, for example, presentation boxes or larger/numerous bottles, may incur additional shipping charges – in this scenario, any additional charges will be advised on the Lot description and hence is assumed to be understood prior to any bid being placed. Asia Whisky Auction reserves the right to update delivery charges as required, but not whilst an auction is live.
  3. Please kindly note that it is Buyer’s responsibility to provide the accurate information for the delivery arrangement, such as receiving address, contact number.  
  4. The delivery service providers may not be able to deliver the goods if they are unable to properly identify the recipient. Please ensure that you are able to provide our provider with a form of photographic ID. Recipients must be over 18 and able to provide proof of this upon delivery. You must ensure that you are available to take delivery of goods at the appointed time. If you are unavailable, delivery providers may return the goods, or may retain the goods and provide you with various options for redelivery or collection, details of which shall be provided to you by the delivery provider. If a buyer is unavailable at the appointed time, and the goods are returned to us, we may cancel the contract for the purchase of the goods.
  5. Asia Whisky Auction team does our utmost to ensure your bottles arrive at you safely, but we cannot be held responsible for the breakage or loss on any uninsured delivery.  To protect you against any loss from broken or lost items in transit, insurance (at standard rate of 3% of the hammer price plus commission) provided by third party insurer is automatically included in that payment process.  Please untick the box if you do not need the insurance service.
  6. Please kindly note that the insurance will only cover breakage or loss in transit. Due to the various ages of bottles and their seals, condition of liquid is at the buyer's discretion and no claim can be lodged against leakage in transit.
  7. Please kindly note that due to the nature of the item(s), which due to aging are sometimes fragile, there may be leakages or deterioration of the item(s) during transit and we recommend that you pick up the item(s) from our office. In the event the buyer agrees to delivery by third party delivery service provider, it is understood that risk in the item(s) will transfer to the third-party delivery service provider on receipt by the third-party delivery service provider of the item(s) from us, following which point we exclude all liability for any loss or damage to the item(s) thereafter including during transit to the buyer’s premises. It is the buyer’s responsibility to have adequate insurance in place to cover the item(s) during transit from our holding office to your desired location.
  8. Before signing for the lot delivered by third party delivery service provider, please kindly check the condition of the parcel carefully.  If the package is damaged or wet, sign the courier's sheet in accordance with the actual condition.  It is not sufficient to sign "unexamined".  Written complaint must be made to the carriers and the senders immediately, otherwise no claim could be considered.
  9. Local taxation, customs and duties may apply with bottles being shipped outside Hong Kong – these charges are to full responsibility of the Buyer.  Asia Whisky Auction is not responsible for payment of such charges and will not refund any bottles returned as a result to Asia Whisky Auction of unpaid customs, duties or VAT charges. 
  10. If we are charged any sales tax, customs charges or duties in relation to the sales or delivery of goods to a buyer, these shall be recharged to the buyer. We will endeavour to ensure details of the same are contained in any listing or delivery information, but we make no guarantee that this will be the case. When we become aware of these we shall notify the buyer.
  11. Please note that Asia Whisky Auction is not responsible for any delays or seizures by customs or any other third party, including couriers.  It is Your duty to adhere to local custom, rules and laws for Your own country.
  12. If You do not collect the Lot from Us within 14 days after a failed delivery to You, You do not re-arrange delivery or collect them from a delivery depot, We will contact You for further instructions and may charge You for storage costs and any further delivery costs. Storage after the 14 days will be charged at a rate of HKD10 per day. Asia Whisky Auction reserves the right to destroy or acquire item(s) which remain within the premises of Asia Whisky Auction after a period of 90 days whereby the Buyer has not made arrangements to collect the item(s).
  13. Asia Whisky Auction offering storage for Buyers to enable them to buy enough bottles to reduce the average delivery cost per bottle.  We will offer free storage in Our secure unit for a period of 90 days after an auction end date, and thereafter a storage fee of HKD10 day per bottle may apply.  The idea is to allow Buyer's the buying selection from subsequent auctions to then ship a larger quantity of bottles and reduce average delivery cost per bottle.
  14. The buyer could re-list the item(s) that you have in storage with us, related seller’s fees would be applied.
  15. Please kindly note that the Seller does not make and does not agree to make any contractual commitment in relation to the satisfactory quality of the item or its fitness for purpose and therefore cannot be held liable for any breach of any undertaking, whether implied by the Sales of Goods Ordinance (Chapter 26 of the Laws of Hong Kong) or otherwise.

  2. Returns and refunds will not be accepted once the sales have been completed.

  2. Asia Whisky Auction reserves the right to cancel any listings and bids at any time, and any contracts concluded for the sale or purchase of item(s), at our discretion.  This will generally be for the following reasons:
  3. the goods are unavailable;
  4. cannot authorise your payments due to us or sellers;
  5. you are not allowed to sell goods through our website;
  6. you are not allowed to purchase goods through our website;
  7. there has been a mistake on the pricing or description of the goods;
  8. seller or buyer has breached these terms; or
  9. there has been no bid for the relevant goods
  10. payment has not been received for won lots within 48 hours of next auction
  11. Goods may be offered (at our discretion) to the next highest bidder.
  12. Suspicious bidding has taken place on a lot
  13. Asia Whisky Auction reserves the right, to the fullest extent legally permissible, to reject any registration, reject any bid placed, alter reserves and to withdraw permissions for a User on Our Website.



  1. Indemnities given by the Buyer
  2. The Buyer agrees to indemnify Us against any and all claims, proceedings, liabilities, costs, expenses or losses against the Seller and/or Us arising from:
  3. any actual or alleged breach of any undertaking or obligation by the Buyer to Us or to the Seller, whether by act or omission (including negligent act or omission) or otherwise;
  4. any personal injury (including death and disease), loss or damage caused to any person by an Item;
  5. the exercising of any of Our rights, powers and/or duties permitted to Us by these Terms;
  6. Your fraud and Our exercising of any of Our rights or powers in the event of fraud;
  7. any error, mis-description or omission in any description of the Lot so long as it was not caused by a breach of Our duty to You under these Terms to exercise reasonable care and skill;
  8. the accessing of the Website; and
  9. any damage to an Item arising as a result of any act or omission of the Buyer or any other person (whether negligent or otherwise) during such time as the Item is in the possession of the Buyer.
